Terms of Service

1. Acceptance of Terms

By accessing or using PolySpy ("the Service"), operated at polyspy.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.

2. Description of Service

PolySpy is a software-as-a-service platform that enables users to detect whale wallet activity on Polymarket, build copy-trading and fade-trading strategies, backtest those strategies against historical data, run them in paper (simulated) mode, and optionally execute live trades through the Polymarket API. The Service also provides Telegram-based alerting and performance analytics.

3. Eligibility

You must be at least 18 years of age to use the Service. By creating an account you represent and warrant that you meet this age requirement.

You are solely responsible for ensuring that your use of Polymarket and the Service complies with all laws and regulations applicable in your jurisdiction. PolySpy does not operate in, and the Service is not intended for use by residents of, jurisdictions where prediction-market trading or the use of automated trading tools is prohibited. Access from such jurisdictions is expressly forbidden.

4. Account Registration & Security

To access the Service you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

If you provide Polymarket API keys or Telegram bot credentials, those credentials are encrypted using AWS Key Management Service (KMS) envelope encryption and are never stored in plaintext. You are responsible for the security of any API keys you provide and must notify us immediately at support@polyspy.app if you believe your account has been compromised.

5. Subscription & Billing

PolySpy offers a 7-day free trial. After the trial period, access to the Service requires a paid subscription at $19.99 per month. Subscription fees are billed monthly on the anniversary of your subscription start date.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will retain access to the Service until that date. No partial refunds are provided for unused portions of a billing period.

We reserve the right to change our pricing with 30 days' advance notice. Continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.

6. Acceptable Use & Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to any part of the Service, other users' accounts, or any systems or networks connected to the Service.
• Reverse-engineer, decompile, or disassemble any portion of the Service.
• Use the Service to engage in market manipulation, wash trading, or any form of fraudulent activity on Polymarket or any other platform.
• Interfere with or disrupt the integrity or performance of the Service.
• Resell, sublicense, or provide access to the Service to third parties without our prior written consent.
• Use automated scripts or bots to access the Service beyond the intended functionality provided by your account.

7. Intellectual Property

All content, features, and functionality of the Service -- including but not limited to text, graphics, logos, software, and the underlying algorithms -- are owned by PolySpy or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written permission.

8. Third-Party Services

The Service integrates with third-party platforms including, but not limited to, Polymarket and Telegram. Your use of these third-party services is governed by their respective terms of service and privacy policies.

PolySpy is not affiliated with, endorsed by, or sponsored by Polymarket or Telegram. We are not responsible for the availability, accuracy, or reliability of any third-party service. Changes to third-party APIs, terms, or availability may affect the functionality of the Service, and we are not liable for any such disruptions.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy or completeness of any data, signals, or backtesting results. Past performance of any trading strategy is not indicative of future results.

10. Limitation of Liability

To the maximum extent permitted by applicable law, PolySpy, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, goodwill, or other intangible losses, resulting from:

• Your access to, use of, or inability to use the Service.
• Any trading losses incurred through strategies built, tested, or executed using the Service.
• Unauthorized access to or alteration of your transmissions or data.
• Any bugs, errors, or inaccuracies in the Service, including backtesting results.
• Failures, delays, or errors in automated trade execution, including slippage, partial fills, or API outages.

In no event shall our total liability to you for all claims arising out of or relating to the Service exceed the amount you have paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless PolySpy and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any trading activity conducted through the Service using your account.

12. Termination

We may suspend or terminate your access to the Service at any time and for any reason, including if we reasonably believe you have violated these Terms or engaged in prohibited conduct. Upon termination, your right to use the Service will cease immediately.

You may delete your account at any time through your account settings. Upon deletion, we will remove your personal data in accordance with our Privacy Policy. Encrypted API keys and credentials will be permanently deleted.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
